On April 11, the CFPB filed its notice of dismissal without prejudice in a case within the U.S. District Court for the Northern District of Texas against a large bank. As previously covered by InfoBytes, the CFPB moved to stay this case’s litigation last March which the court denied. The court opined that the Bureau failed to explain how a stay in litigation “would be in the interest of justice.” In response, the CFPB filed an amended complaint against the bank alleging violations of the CFPA, the EFTA, and its implementing Regulation E (covered here), to which the bank replied to (also covered here).

The lawsuit, which was originally filed in December 2024 (and under prior CFPB leadership), alleged the bank mismanaged a government benefit card program.
