Maryland governor signs law expanding virtual currency kiosk operator definition, clarifying ATM distinction
On May 12, the Maryland governor signed into law SB 741, enacting changes to the state’s regulatory framework for virtual currency kiosks. The legislation broadens the definition of “virtual currency kiosk operator” to include any person who “installs or operates software that enables a stand-alone automated device to provide virtual currency services in the State.” The law also narrows the scope of “virtual currency services” by excluding the acceptance or dispensing of cash tied to credit, deposit or convenience accounts — activity that falls under Maryland’s existing ATM regulatory framework. The measure requires virtual currency kiosk operators to ensure their kiosks do not “provide the same services as an automated teller machine.” The legislation takes effect October 1.
