CFPB files notice of appeal to the Ninth Circuit in funding dispute

On May 11, the CFPB filed a notice of appeal to the U.S. Court of Appeals for the 9th Circuit, challenging a March 13 order from the U.S. District Court for the Northern District of California that required the Bureau to continue requesting operating funds from the Fed. As previously covered by InfoBytes, the district court held that the CFPB director is required to request funding from the Fed under 12 U.S.C. § 5497 and that the Bureau’s reliance on a DOJ Office of Legal Counsel interpretation of its funding statute was arbitrary, capricious, and contrary to law.
