Oregon governor signs DIDMCA opt-out bill into law

On April 7, Oregon Governor Tina Kotek signed into law House Bill 4116, completing the state’s opt-out of Section 521 of the DIDMCA for consumer finance loans made in the state. As previously covered by InfoBytes, the law declares that Oregon “does not want” the amendments in Section 521 — which extend insured state banks the same rate exportation authority as national banks — to apply to consumer finance loans made in Oregon, subjecting such loans to the state’s own licensing and regulatory framework. The law takes effect on the 91st day after adjournment of the legislature’s 2026 regular session.
