CFPB seeks comment on reinstating mortgage advertising and land sales information collections
On March 20, the CFPB published a notice in the Federal Register requesting public comment on the reinstatement of an information collection titled “Mortgage Acts and Practices—Advertising (Regulation N).” Regulation N prohibits misrepresentations about the terms of mortgage credit products in commercial communications and requires covered persons to retain certain related records for 24 months from the date of last dissemination. The notice requested the Office of Management and Budget (OMB) reinstate the collection, which the CFPB stated is necessary to ensure efficient and effective law enforcement against deceptive mortgage advertising practices. The CFPB issued a separate reinstatement notice on March 20 regarding an information collection titled “Interstate Land Sales Full Disclosure Act (Regulations J, K, and L),” which required land developers to register subdivisions of 100 or more non-exempt lots with the CFPB before selling or leasing the lots and to provide each lot purchaser with a property report. Both notices requested public comments by April 20 on whether the collection of information is necessary or useful for the proper performance of the functions of the CFPB, the accuracy of the estimated burden, and ways to enhance the collected information and minimize the burden thereof.
As previously covered by InfoBytes, in December 2025, the CFPB published eight notices in the Federal Register requesting comment on reinstating OMB approvals for existing information collections, including both Regulation N and the Interstate Land Sales Full Disclosure Act (Regulations J, K, and L).
