Sixth Circuit to receive Regulation II interchange fee case after plaintiff’s appeal

On November 10, the plaintiff filed a notice of appeal to the U.S. Court of Appeals for the 6th Circuit, seeking review of a district court decision denying the plaintiff’s, and granting the Fed’s, motion for summary judgment, thereby upholding Regulation II, which caps debit card interchange fees. As previously covered by InfoBytes, the U.S. District Court for the Eastern District of Kentucky had granted summary judgment in favor of the Fed in September, rejecting arguments that the regulation was inconsistent with the Durbin Amendment or arbitrary and capricious.
