CFPB reportedly settles with defendant in military lending case
On October 15, a judge from U.S. SDNY granted the CFPB and opposing counsel’s joint letter-motion requesting the court adjourn briefing on a Rule 12(c) motion filed by defendants on July 21. The parties had reported they had reached an agreement in principle to fully resolve the action — including injunctive and monetary terms — and were in the process of drafting the agreement with plans to submit a proposed stipulated judgment by November 3. The joint request sought to pause the briefing schedule to give both sides time to finalize the agreement.
As previously covered by InfoBytes, the CFPB stated previously it would continue pursuing this case under the new administration. Most of the CFPB’s original complaint survived a motion to dismiss (covered here), but the Bureau filed a second amended complaint on April 22.
