District court stays CFPB’s Small Business Lending Rule again

On September 9, the U.S. District Court for the Eastern District of Kentucky stayed a case challenging the CFPB’s Small Business Lending Rule until December 1, 2025, while the CFPB conducts new rulemaking which could render the dispute moot. In response to the CFPB moving for the stay, the plaintiffs had requested the court set a specific deadline for the CFPB to answer their amended complaint, seeking clarity on the CFPB’s positions under the rule. The court declined that request as “not necessary” and instead directed the CFPB to file a status report on the progress of its rulemaking on or before December 1. The case was previously stayed on May 30.
