Maryland enacts new earned wage access law

On May 25, the Maryland General Assembly chaptered HB 1294 and affirmatively subjected earned wage access products to the Maryland consumer credit and licensing provisions. The law requires companies that offer earned wage access products to become licensed and establishes notification requirements regarding the fees associated with such products. Earned wage access providers must also offer consumers a no-cost option for accessing these services. The law includes a provision exempting licensees from other state laws concerning lending, credit, or debt, including provisions addressing interest rates, consumer loans, and revolving and closed-end credit. The act takes effect on October 1.
